Is Mediation a Good Option?

Many people requesting a consultation from an attorney at Shelbourne Law ask the question “Should (or can) I sue this person?” The answer varies depending on the situation. In some cases we recommend mediation, also known as alternate dispute resolution (ADR). The next question is usually “Why would I want to use mediation?” Here are the answers in a nutshell:

Mediation Can Be Faster
Lawsuits can be time-consuming, sometimes taking years to get to trial. Mediation can usually be accomplished in a much shorter time.

Mediation is More Cost-Effective
The timeline and speed of mediation means there is much less cost involved. A long, complicated court case requires significant legal fees for both parties.

Mediation Offers Flexibility to Each Side of a Dispute
As a mediator works with both parties to find a mutually acceptable resolution, the focus can be on finding things that are acceptable to both parties, as opposed to declaring opposing positions that are defined and defended.

Mediation Offers More Privacy
Court cases are public but mediation is usually private to the mediator and the parties involved.

Mediation Can Help Preserve Relationships
A long court case often damages the relationships of the many people involved. There are winners and losers. Since the goal of mediation is to find a solution that works for both parties, a successful mediation can create a collaborative effort with a more positive outcome.
